Terms of Service

Welcome to Subworkit. By accessing or using the Subworkit platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, customers, service providers, and any other users who access or use the platform.

1. Use of the Platform

Subworkit provides a two-sided marketplace that connects customers seeking services with independent service providers. Subworkit is not a party to any service agreement between customers and providers and does not employ service providers. You must be at least 18 years old to create an account and use the Service.

2. Accounts

You are responsible for maintaining the security of your account credentials. You agree not to share your password, create accounts using false information, or use another person's account without permission. Subworkit reserves the right to suspend or terminate accounts that violate these Terms.

3. Service Requests and Bids

Customers may post service requests describing work they need done. Service providers may submit bids in response. Acceptance of a bid forms a direct agreement between the customer and provider — Subworkit facilitates but is not a party to that agreement. Customers agree to provide accurate descriptions of the work required.

4. Payments and Escrow

Payments for services are processed through Subworkit's escrow system. Funds are held securely and released to the service provider upon job completion and customer confirmation. Platform fees are deducted before payout. Refund eligibility is governed by our Dispute Resolution Policy available in the Help Center.

5. Prohibited Conduct

Users may not: post false reviews or manipulate ratings; use the platform to solicit off-platform payments to circumvent fees; harass, threaten, or discriminate against other users; post illegal content; or attempt to reverse-engineer or scrape the platform. Violations may result in immediate account termination.

6. Intellectual Property

Subworkit and its licensors own all intellectual property rights in the platform, including trademarks, software, and design. You retain ownership of content you submit (reviews, photos, descriptions) but grant Subworkit a license to display and distribute that content in connection with the Service.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Subworkit's liability for any claim arising from use of the Service is limited to the fees you paid to Subworkit in the 12 months preceding the claim. Subworkit is not liable for the quality, safety, or legality of services provided by independent service providers.

8. Dispute Resolution

Disputes between customers and service providers should first be submitted to Subworkit's in-platform dispute resolution system. Disputes between you and Subworkit are governed by binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by applicable law.

9. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought in the courts of San Francisco County, California.

10. Changes to These Terms

Subworkit may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will notify users of material changes via email or in-app notification.
